Introduction
Public procurement is a vital part of local public administration, not only in terms of the strict regulations governing the use of public funds but also in terms of administrative efficiency. According to the statistical report by the National Agency for Public Procurement (ANAP) for the period from 01.01.2022 to 31.12.2022, 32,087 procurement procedures were initiated, of which 19,045 were simplified procedures and 12,230 were open tenders. The estimated value of contracts monitored through SEAP was 27,220,901,727,000 lei for open tenders and 3,207,656,854,000 lei for simplified procedures.
Complexity of Public Procurement Procedures
The organization and execution of a public procurement procedure is a complex activity that includes a wide range of tasks, from preparing documentation, to evaluating offers, and finally awarding contracts. The law allows contracting authorities to turn to auxiliary service providers to obtain assistance and advice for the proper conduct and structuring of public procurement procedures. Since 2018, our company has identified this need and built a specialized team to offer consultancy services to contracting authorities, particularly administrative-territorial units.
Services Offered:
Our company provides consulting services for conducting procurement procedures regulated by Law no. 98/2016 on public procurement, Law no. 99/2016 on sectoral procurement, and Law no. 100/2016 on concessions for works and services. As part of our services, we offer consultancy for the preparation of procurement documentation and provide specialized assistance throughout the public procurement procedure.
We carry out the following activities with professionalism, within the agreed deadlines, and to the highest standards:
- Developing the contracting strategy, preparing the specifications, forms, contract model, and uploading the procurement documents in the SICAP platform, including all communications during the evaluation process.
- Drafting expert reports for the evaluation committee regarding the drafting of the minutes for offer visualization, verifying the participation guarantee, and evaluating the DUAE, as well as drafting the necessary minutes.
- Preparing expert reports for the technical evaluation of the offers and drafting the necessary minutes.
- Financial evaluation of the offers, and drafting the minutes concerning the compliance of the DUAE.
- Notifying the evaluation committee about the need for clarification requests to be sent to economic operators, and drafting those requests at all stages of the procedure.
- Assisting the contracting authority in drafting responses to clarification requests from economic operators.
- Drafting the final report of the procedure and registering the evaluation results in SICAP.
- Specialized assistance for any other issues arising during the procurement process.
- Support in case of appeals, according to Law no. 101/2016, regarding remedies and appeals in public procurement, sectoral procurement, and concession contracts.
- Assistance in responding to ANAP in case of an ex ante control, according to O.U.G. 98/2017, for contracts selected for such audits.
